OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD).
You agree to indemnify, defend, and hold harmless EVChargeSpec and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

These Terms and any dispute arising from your use of the Site shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
This section requires binding arbitration of disputes and waives your right to participate in a class action.
Agreement to Arbitrate: Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site — except claims that qualify for small claims court — shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: YOU AND EVCHARGESPEC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first using the Site. Your notice must include your name, email address, and a clear statement that you are opting out of arbitration.
Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting on this page. The "Last updated" date above indicates the most recent revision. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.
